Online shop Schaffashoes.pl is conducted by: Pezet Sp. z o.o. Sp. k., ul. KEN 97/5, 02-722 Warszawa, NIP: 9512381748, REGON: 147186522.

I. Acceptance and implementation of orders.

  1. The Shop conducts sales of goods via Internet and chain of authorised retails shops.
  2. All the products offered in the Shop are factory brand-new and brought legally into the territory of Poland. The goods are free of defects.
  3. The Customer of the Shop can be a natural person possessing a full or restricted legal capacity and a legal person.
  4. Customers’ orders are accepted exclusively via Internet page www.noosicon.com.
  5. A Customer who has sent an order to the Shop makes an offer to enter into the contract of sale of the ordered goods with the Shop. Confirmation of the order acceptance sent by the Shop to the e-mail address given by the Customer means declaration of the order acceptance mentioned above.
  6. In case of goods covered by the order are unavailable in the stock, from suppliers of the Shop or for other reasons and it is impossible to implement the Customer’s order, the Shop will inform the Customer about it within at the latest 30 (thirty) days from the date of the contract conclusion and reimburse the money paid. The notification will be sent to the e-mail address indicated by the Customer in the order form.
  7. The ordered foods are delivered in priority parcel with DPD courier, Kiosk Ruchu, Inpost. Easypacks.
    Choosing the PDP courier, the purchaser is charged with the following costs on the territory of Poland:
    • PLN 9,90 regardless of a number of the ordered items in case of non-COD services.
    • PLN 9,90 regardless of a number of the ordered items in case of COD services.
    Choosing Easypacks the purchaser is charged with the following costs on the territory of Poland:
    • PLN 6,90 regardless of a number of the ordered items in case of non-COD services.
    • PLN 6,90 regardless of a number of the ordered items in case of COD services.
  8. In case of service out of Poland the cost is negotiated individually prior to confirmation of the order by the Customer.
  9. After confirmation of the order acceptance, the Shop is obliged to send the Customer the foods in compliance with the order within 2 business days unless the Customer consents on other time or other terms.
  10. The Customers are informed about the status of the order via electronic mail.
  11. If the order is not confirmed within 5 days, it is cancelled.
  12. The Customer, who receives the ordered parcel, should check the condition of the parcel. If any damage is stated or packaging is unsealed, the damage protocol should be prepared in presence of the courier. The damage protocol sent to the Shop along with the complaint will be considered more easily.
  13. During sales and promotions discount codes and newsletter codes etc. are not approved. During sales and promotions it is impossible to combine parcels or change any sizes and orders (despite address changes) and time to implement the order is prolonged due to a great number of orders.
  14. Implementation of the order Turing sales can exceed over 7 business days.

II. Prices of the goods.

  1. All the prices of the goods placed on the Internet page of the Shop are in PLN, include VAT and do not contain information about service costs.
  2. Any price mentioned on each product is binding after the Customer has made an order.
  3. A VAT invoice or receipt is a proof of sale.
  4. During sales and promotions discount codes and newsletter codes etc. are not approved. During sales and promotions it is impossible to combine parcels or change any sizes and orders (despite address changes) and time to implement the order is prolonged due to a great number of orders.
  5. Newsletter codes and discount codes refer to products without price reduction, above PLN 150.
  6. The Shop reserves the right to change prices of the goods, launch and cancel promotion campaigns and sales or make changes in them. The above entitlement does not influence prices of the goods in the orders made prior to the date of entry into force of the change of the price, terms and conditions of promotion campaigns or sales.

III. Complaints.

  1. Under consumer’s law, the goods sold via electronic way are covered with a 2-year guarantee.
  2. If the goods are not in conformity with the contract of sale, the Customer has the right to make a complaint in the Shop. The entitlement is valid within 2 (two) years from the date of delivery of the goods provided that the Shop has been informed about the non-conformity within 2 (two) months from its discovery.
    In this case the Customer should sent the goods to the address of the Shop:
    Schaffa (lokal użytkowy UH-5), ul. KEN 97, 02-722 Warszawa.
    The goods sent shall be attached by the invoice and complaint form filled in which is available to download in the Complaints tab. In the form the Customer Has to determine which option they are interested in: repair or exchange of the goods or refund.
  3. The goods should be sent in Polish Post economic parcel (registered parcels are not delivered to the Shop). The Shop does not receive any COD parcels.
  4. The Shop, within at the latest 14 days from the date of delivery of the parcel with the ordered goods, will reply to the complaint filed and inform the Customer about further proceedings. If the complaint is considered favourably, the defective goods will be repaired or exchange for the new ones, full-quality. If it is impossible (e.g. due to exhaustion of stocks), the Shop will give a full refund. Costs in relation to sending the claimed foods ( economic parcel) are covered by the shop after considering the complaint favourably. The shop does not accept any cash-on-delivery parcels.

IV. The right to withdraw from the contract.

  1. Under the Act of 2 March 2000 on protection of some consumer rights and liability for damage caused by dangerous product , the Customer who is a natural person purchasing for the purpose unconnected with professional activity or business, can withdraw from the contract without giving a reason within 30 days from the date of delivery of the parcel. The Customer should make a declaration about withdrawal from the contract and return the goods to the Shop.
  2. The goods returned should be returned in an unchanged condition unless the change was necessary in the ordinary management. In particular, the foods should be returned in an original packaging. If the foods are returned in a changed condition when the change was necessary in the ordinary management including return without an original packaging, the Shop reserves the right to make a compensation.
  3. The goods returned has to be sent within at the latest 30 days from the date of withdrawal from the contract to the address:
    Schaffa (lokal użytkowy UH-5), ul. KEN 97, 02-722 Warszawa.
    The Shop does not receive any COD parcels. Costs in relation to sending the goods back are not reimbursed.
  4. The shop reimburses money for the goods returned within 14 days from the register of the goods returned in the system. The Customer is informed about the return via e-mail message.

V. Final provisions.

  1. Contract of sale is concluded between the Customer and Pezet Sp. z o.o. Sp. k., ul. KEN 97, 02-722 Warszawa.
  2. The goods presented on www pages of the online Shop do not constitute in the meaning of the Civil Code. Information about goods placed on www pages does not mean that the goods are available in the stock of the Shop or with its suppliers.
  3. The Shop does not bear responsibility for mistakes in the order service or other Customer’s instructions caused by giving wrong data by the Customer.
  4. The Shop does not bear responsibility for transactions made by unathorised third parties who gained an access to the Customer’s account due to not keeping precaution principles by the Customer while using their account login and password.
  5. In all the matters not regulated by these Rules, provisions of the Polish law are applicable , in particular of the Civil Code, the Act on specific terms and conditions of consumer sales and amendments of the Civil Code (Journal of Laws No. 141 of 2002, item1176, as amended ) and provisions of the Act on protection of certain consumer rights and liability for damage caused by dangerous products (Journal of Laws no. 22 of 2000, item 271 as amended).
